Robert Pettinger appealed a district court judgment dismissing his lawsuit against the estate of his brother, James Pettinger ("the Estate"). The court granted summary judgment in favor of the Estate, concluding Pettinger's lawsuit was untimely and barred by the applicable statute of limitations. Pettinger contended material questions of fact exist precluding summary judgment.
